These Terms & Conditions ("Terms") govern your access to and use of DJ Queue Play My Song (the "Service"), operated by Bug Out Software Solutions LLC ("we", "us", "our"). By using the Service you agree to be bound by these Terms.
1. The Service
DJ Queue Play My Song is a real-time song-request platform that allows DJs to create sessions and allows event guests to submit and vote on song requests. Depending on the plan, the Service may also include guest photo sharing, tipping via Stripe Connect, analytics, TV display mode, and related features.
2. Acceptance & Eligibility
By continuing to use the Service you accept these Terms. You must be of legal age in your jurisdiction and, if using the Service on behalf of an organization, have authority to bind that organization.
3. Account & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.
4. Acceptable Use
You must not misuse the Service. Prohibited conduct includes, without limitation:
- unlawful, fraudulent, or deceptive activity;
- spam, harassment, hate speech, or infringement of third-party rights;
- interfering with security, probing, scraping, or introducing malware;
- reverse engineering, reselling, or circumventing technical limits of the Service.
5. Intellectual Property
The Service, including its software, design, and branding, is owned by Bug Out Software Solutions LLC and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of content you submit and grant us a limited license to host and process it solely to operate the Service.
6. Payments, Subscriptions & Taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, renewal, cancellation and refund mechanics are governed by Paddle's Buyer Terms, together with our Refund Policy.
7. Guest Photos & Content Moderation
Where guest photo sharing is enabled, guests may upload photos to a session and the DJ reviews and approves or rejects them before display. We reserve the right to remove or restrict any content that violates these Terms, to refuse to display content, and to suspend accounts for repeated or serious violations. Uploading guests must own or have rights to the photos they submit, and photos may not contain unlawful, infringing, harassing, or explicit material.
8. Tipping & Payouts (Stripe Connect)
Where enabled, guests may send voluntary tips to a DJ through Stripe Connect. Tips are processed by Stripe, Inc. under Stripe's terms; Bug Out Software Solutions LLC does not hold or transmit tip funds. A platform fee of 3.1% + $0.40 is deducted from each tip, and Stripe's own processing fees may apply. Payouts to DJs are handled by Stripe under the Stripe Express agreement; DJs are responsible for any taxes on tips they receive. Tips are voluntary and are generally non-refundable except where required by law or by Stripe. This tipping flow is separate from subscription purchases, which are processed by Paddle (see below).
9. Service Availability
We do not guarantee that the Service will be uninterrupted, error-free, or free from loss of data. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension & Termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. Upon termination your right to use the Service ends; we may delete associated data after a reasonable export window.
11. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 6 months preceding the claim. We are not liable for indirect, consequential, special, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Indemnification
You agree to indemnify and hold Bug Out Software Solutions LLC harmless from claims arising out of your content, unlawful use of the Service, or breach of these Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which Bug Out Software Solutions LLC resides, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer law.
14. Assignment
You may not assign or transfer these Terms or your rights hereunder to any third party without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
15. Force Majeure
We are not liable for any delay or failure to perform our obligations arising from events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, or widespread internet or infrastructure failure.
16. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
